Explanation

The word prokuratura comes from the Latin “procurare” – to care for. The prosecutor’s bodies supervise the uniform and correct execution of laws, take part in fighting crime and appear in court as the state prosecutor. It is not part of the court system: it accuses or supervises but does not pass judgment. The prosecutor’s office is a centralised system headed by the Prosecutor General; lower prosecutors are subordinate to higher ones. On finding a violation of law a prosecutor may lodge a protest, or issue a submission, a resolution or a warning. To stay impartial, prosecutors may not be members of a political party or engage in business. The President and the Senate both take part in placing the Prosecutor General in office.

Worked examples
A company unlawfully withholds wages: a prosecutor may investigate and send the manager a submission.
When a criminal case comes to court the prosecutor supports the charge, but the court passes the sentence.
