The signs of a crime and the elements of a crime
Answers are for parents and teachers.
1
Write one fictional situation and identify its four elements (without real persons or events).
The answer depends on the example: object, objective side (act, consequence), subject (age and sanity) and subjective side (intent or negligence, motive) must be clearly identified.
2
Write the difference between negligence and intent in three sentences.
With intent the person understands the danger and wants the result or consciously allows it; with negligence he does not want the result but allows it through overconfidence or carelessness.
3
In two sentences write the basic condition for necessary defence to be lawful.
The defence must be against a real and unlawful attack, and must be proportionate to the danger of the attack, not slipping into excessive violence.
4
Why is an insignificant act not a crime? Explain briefly.
Because it is not socially dangerous: even if it superficially resembles a sign in the Code, it causes no serious harm to society or an individual and does not deserve criminal punishment.
