Explanation
The Constitution obliges parents to support and raise children until adulthood and adult able-bodied children to care for their parents. Serious breaches of these duties are protected by the Criminal Code as separate crimes. Evading the support of a minor or a person unable to work means failing, for more than two months in total, to pay money (such as aliment) that must be recovered under a court decision or order; evading the support of parents is likewise based on a court decision and its period is set by law. These crimes are deliberate, and the subject is a sane person aged 18 or over on whom a support duty was imposed by a court decision; in some cases administrative liability must already have been applied before criminal liability follows. Involving a minor in anti-social behaviour (begging, alcohol, drug use, committing crimes) is also a crime: the offender must know that the person is a minor, and liability becomes more serious if it happens at an educational institution or place where students gather, or involves several children.
Worked examples
Aliment: a court ordered that maintenance for his son be recovered from Eldor’s salary, but although he received wages he did not pay for three months. This resembles evasion of support and may bring liability if the legal conditions are met.
Involvement: a 20-year-old, knowing the age of a 15-year-old, repeatedly persuaded him to drink alcohol. He may be held liable for involving a minor in anti-social behaviour.
Class activity
Role play: “Advice centre” — one student plays a parent, another a lawyer; the lawyer explains in general terms what the duty to pay support under a court decision means.
Practice
1
What is the main feature of the crime of evading support?
Not paying money required by a court decision for more than two months in total.
2
Who can be the subject of such a crime?
A sane person aged 18 or over with a support duty imposed by court decision (for example a parent).
3
Which acts are examples of involving a minor in anti-social behaviour?
Inducing begging, alcohol or drug use or committing a crime.
4
Why is involving minors in such behaviour a serious crime? Justify.
Because children yield quickly to adult influence, seriously harming their health and moral development and raising the risk of entering a criminal path.
